Terms of Service

Welcome to CreateImage.in ("we", "our", or "the Platform"). By registering an account, accessing our web studio, subscribing to a plan, or integrating with our Developer REST API, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must refrain from using the Platform.

1. Nature of the Service & "AS-IS" Availability

The Platform provides an automated AI image generation studio and developer API hub that coordinates complex neural synthesis pipelines, warm browser clusters, and automated request processing.

⚠️ Disclaimer of Warranties ("AS-IS" & "AS-AVAILABLE")

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO UNINTERRUPTED UPTIME, SERVER CAPACITY, SPEED, TIMELINESS, OR ERROR-FREE IMAGE GENERATION. YOU EXPRESSLY ACKNOWLEDGE THAT AI MODELS MAY EXPERIENCE HIGH TRAFFIC LOADS, TEMPORARY QUEUE DELAYS, OR DOWNTIME WITHOUT LIABILITY TO THE PLATFORM OPERATOR.

2. Abuse Detection, Account Suspension & Termination

To preserve platform security, worker cluster stability, and fair resource allocation for all users, administration strictly monitors all incoming prompt requests and API usage.

We reserve the right, at our sole and absolute discretion, to immediately suspend, throttle, block, terminate, or ban any user account, IP address, or permanent API Key without prior notice or refund if we detect:

  • Automated Denial of Service (DoS/DDoS), server spamming, or excessive rapid-fire requests bypassing rate limits;
  • Prompts generating unlawful, abusive, defamatory, sexually explicit, harmful, or copyright-infringing content;
  • Unauthorized sharing, reselling, or public leaking of permanent Developer API keys;
  • Attempting to reverse-engineer, decompile, scrape, or interfere with our automated Chrome worker cluster;
  • Submitting fraudulent payment claims, fake UTR transaction numbers, or forged payment screenshots.

3. Subscription Plans, Quotas & Fair Use

Each registered account is assigned a daily generation quota based on their active subscription tier (Free, Pro Creator, Studio Agency, or Unlimited VIP). Daily quotas reset at midnight. Unused daily quota allocations do not roll over to subsequent days.

4. Intellectual Property & Commercial License

Subject to compliance with these terms:

  • Images generated on Free Starter accounts are licensed for personal, educational, and testing use;
  • Images generated on Pro Creator, Studio Agency, and Unlimited VIP tiers include full commercial rights for use in client projects, blogs, social media, and digital advertisements.
  • You warrant that your prompt inputs do not violate third-party trademarks or copyrights.

5. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL THE PLATFORM, ITS OWNERS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES RESULTING FROM SERVICE OUTAGES, LOST PROFITS, DELAYED IMAGE DELIVERIES, OR INACCURATE VISUAL OUTPUTS. IN ALL EVENTS, OUR TOTAL AGGREGATE LIABILITY SHALL BE STRICTLY LIMITED TO THE AMOUNT PAID BY YOU TO THE PLATFORM IN THE THIRTY (30) DAYS PRECEDING THE CLAIM.

6. Modifications & Contact
